This two-part institution, made up of the Rajya Sabha (Council of States) and the Lok Sabha (House of the People), acts as the highest lawmaking body, creating laws that shape the country's future. Set up in 1952, the Parliament reflects the spirit of India's diverse people, with representatives chosen from all over the country. It has the power to look closely at what the government does, making sure it is responsible and open. Through its many groups, the Parliament looks into important issues, from money and foreign relations to social well-being and environmental concerns. The Constitution of India provides for a parliamentary form of government in which the parliament is the legislative organ or law-making organ of the Union Government. The Indian Parliament comprises three parts i.e. <ol> <li>President</li> <li>Lok Sabha (i.e. House of People)</li> <li>Rajya Sabha (i.e. Council of States)</li> </ol> Let's discuss these three parts in details. <h2 id="content-id-1914-1">President</h2> In the tapestry of India's democratic republic, the President stands as a symbol of unity, embodying the nation's highest constitutional office. Elected indirectly by an electoral college, the President serves as the ceremonial head of state, representing the nation's sovereignty and upholding its constitutional values. The President's role encompasses a spectrum of responsibilities, from safeguarding the Constitution to granting pardons and approving legislation. As the Supreme Commander of the Armed Forces, the President bears the mantle of national defense and represents India on the global stage. The President's stature transcends political divides, symbolizing the nation's collective aspirations and embodying the spirit of India's diverse populace. Through their actions and words, the President inspires unity and fosters a sense of national pride, epitomizing the essence of India's democratic spirit. So, in simple words, the President of India is the Nominal executive and Head of the Indian State and is symbolic of unity, integrity and solidarity of the nation. He is the first citizen of India. <h3>The Election to the president is indirect through an Electoral College comprising of:</h3> <ol> <li>The elected members of both the Houses of Parliament</li> <li>Elected Members of Legislative Assembly of States</li> <li>Elected Members of Legislative Assembly of Union Territories with legislature</li> </ol> <h3>Qualifications for a person to be eligible for election to the office of President:</h3> <ol> <li>He should be a citizen of India.</li> <li>He should have completed the age of 35 years.</li> <li>He should be qualified for election as a member of the Lok Sabha.</li> <li>He should not hold any office of profit under the Union or any State government.</li> </ol> The Oath to the Office of President is administered by the Chief Justice of India or in his absence the senior most judge of the Supreme Court. <img alt="President of India" src="https://www.thedhronas.com/admin/assets/uploads/ckeditor/President of India.webp" style="height:200px; width:400px"> [Source: The Hindustan Times] The current President of India is Smt. Draupadi Murmu. The President holds office for a term of five years. He can hold the office beyond five years until his successor assumes charge. He is eligible for re-election to that office. He can resign before five years by writing to the Vice President or can be removed through the process of Impeachment. The impeachment process for removal of the President can be initiated in either House of Parliament for ‘violation of constitution’. As to what constitutes this violation is not mentioned in the constitution. The charges should be signed by one-fourth members of the house that initiated the charge and a 14-day notice should be given to the President. The President also enjoys ordinance making powers when both or any of the houses are not in session. The Ordinance so promulgated has to be approved by both the houses within six weeks of their reassembly and as there can be maximum six months between two sessions of Parliament in a year, the ordinance survives for maximum six months and six weeks. The President also has certain pardoning powers. He can <ol> <li>Remit</li> <li>Reprieve</li> <li>Respite</li> <li>Pardon</li> </ol> sentences in case of Union Law, sentence by Court Martial and death sentences even of State Laws. Further the president has the powers to proclaim emergency. Under Article 352 of the constitution, he can proclaim national emergency on the ground of war, external aggression or armed rebellion only on the advice of the Union Council of Ministers by the 44th Amendment Act. He can proclaim emergency in a state also known as President’s Rule on the recommendation of the Governor or by himself on the advice of Union CoM. The financial emergency is proclaimed on the advice of Union CoM. So, this is the basic knowledge about the President of India. We will discuss all the powers and functions of the President of India and also about the vice President of India in next blog. Now, let's move on to the next part of the Indian Parliament i.e. Lok Sabha. <h2 id="content-id-1914-2">Lok Sabha</h2> The Lok Sabha or House of People is the lower house of Indian Parliament, elections to which are direct. The Maximum strength of the Lok Sabha is fixed at 552. At present, the Lok Sabha has 545 members. Of these 530 members represent the states, 13 represent the Union territories. There are seats reserved in Lok Sabha on the basis of population ratios i.e. from each state such number of seats will be reserved for SCs and STs as their respective proportion in the population of the concerned state without any separate electorates. The duration of Lok Sabha is for five years. However, it can be dissolved prior to the completion of five years also on the recommendation by the Prime Minister to the President or in certain other cases as well. <img alt="Lok Sabha Indian Parliament" src="https://www.thedhronas.com/admin/assets/uploads/ckeditor/Lok Sabha Indian Parliament.webp" style="height:200px; width:400px"> [Source: The Print] The Lok Sabha is presided over by the Speaker who is elected from among the members of the house itself and by members themselves on such a date as assigned by the President. Further, he can be removed from his office by passing a resolution supported by a majority of total membership of the house i.e. above 50%. He can also resign by giving his resignation to the Deputy Speaker. He is responsible for carrying out the day-to-day business of the house adjourning the sitting or adjournment since the sitting along with deciding on the question of disqualification of a member on grounds of defection. He also presides over the joint sitting of the two houses and decides on the question whether a bill is a money bill or not. The Deputy Speaker is also elected from among the members by them and takes the speaker’s responsibility in his absence. He resigns writing to the Speaker. Now, let's look at the third part i.e. Rajya Sabha. <h2 id="content-id-1914-3">Rajya Sabha</h2> The Rajya Sabha or Council of States is the upper house of Indian Parliament, elections to which are indirect. The maximum strength of the Rajya Sabha is fixed at 250. At present Rajya Sabha has 245 members. Of these, 229 represent the states, 4 represent the Union Territories and 12 members are nominated by the President on the recommendation of the Union Cabinet. The nominated members are experts or eminent personalities from art, literature, science and social service. The members of Rajya Sabha are indirectly elected by the elected members of state legislative assemblies. However, one-third of its members retire every second year. The term of members of Rajya Sabha is six years. The President decides the order of retirement of members of Rajya Sabha. The Rajya Sabha is presided over by the Chairman of Rajya Sabha. Vice President of India acts as the ex officio chairman of Rajya Sabha. This is just an introduction to Rajya sabha and Lok Sabha. We will discuss about Lok Sabha and Rajya Sabha in detail in our upcoming blogs. For now, let's look at some important concepts regarding the Parliament of India. <h2 id="content-id-1914-4">Some important concepts regarding the Parliament</h2> 1. Summoning: The President of India summons, on PMs Recommendation, each house for carrying out the session. There cannot be more than six months gap between two sessions i.e. there cannot be less than two sessions in a year. Usually there are three sessions viz. Budget, Monsoon and Winter. 2. Adjournment: A sitting of the house is terminated through adjournment which is issued by the speaker of the house. 3. Adjournment Sine Die: Termination of a sitting for an indefinite period is known as adjournment sine die which is also issued by the speaker of the house. 4. Prorogue: After every session of Parliament is over following a few days the President issues the order for prorogation which marks the end of session and house is summoned again. 5. Ordinary Bills: Bills concerning any matter other than financial are known as ordinary bills. Once they are passed by the introducing house the next house can either accept, reject or put amendments to the bill. Such amendments may or may not be accepted by the original house. 6. Money Bills: Article 110 of the Constitution deals with the concept of money bills which are concerned with taxation, borrowing, expenditure etc. They necessarily are introduced in Lok Sabha and with prior recommendation of the President. Further, before transmitting to Rajya Sabha, the speaker certifies the bill as Money Bill. Money Bill cannot be rejected or amended by Rajya Sabha, which can only put suggestions which may or may not be accepted by Lok Sabha. 7. Financial Bills: Article 117 of the constitution deals with Financial Bills. There are two types of Financial Bills: Financial Bill I which can be introduced only in Lok Sabha and can only be introduced on the recommendation of the President, except this, Financial Bill I is just like an ordinary bill. Financial Bill II does not concern matters mentioned in Article 110 and Presidential recommendation is required at the consideration stage, except this, for all other matters they are treated just like ordinary bills. 8. Joint Sitting: In case the second house rejects the bill passed by the first or the amendments proposed by it are not accepted by the first house, a deadlock takes place which is resolved by the joint sitting of the two houses summoned by the President. The bill is passed with majority of the members present and voting i.e. simple majority. Further joint sitting is not summoned for Constitution Amendment Bills and Money Bills. The speaker of Lok Sabha presides over the joint sitting and in his absence, the Deputy Speaker of Lok Sabha and even in his absence, the Deputy Chairman, Rajya Sabha. 9. Question Hour: The first hour of every sitting is slotted for this. There are three types of questions asked: <ol> <li>Starred question: Requires oral reply hence supplementary question can follow.</li> <li>Unstarred question: Requires written answer, hence supplementary question cannot follow.</li> <li>Short Notice question: Notice of ten days is given prior to it. <h2 id="content-id-35366-0">President of India</h2>

The President is the head of the Republic of India and is the first citizen of India. Article 53 of the Indian Constitution states that all the executive powers of the Union shall be exercised by him either directly or through officers subordinates to him.

In the Constitution Part V (The Union) under Chapter I (The Executive) details of qualifications, election and impeachment of the President of India are given. That is Articles from 52 to 78 in Part V of the Constitution deals with the Union Executive. The President of India is also the head of the executive, legislature and judiciary of the country. 

The President holds office for a tenure of five years from the date on which he enters upon his office. However, he can resign from his office at any time by addressing the resignation letter to the Vice-President. Further, he can also be removed from the office before completion of his term by the process of impeachment. The President can hold office beyond his term of five years until his successor assumes charge. He is also eligible for re-election to that office.

The Electoral College elects the President of India, which includes the elected members of both the Houses of Parliament, the elected members of the legislative assemblies of the states and the elected members of the legislative assemblies of the Union Territories of Delhi and Pondicherry and the representation of its members is preferential.

The current President of India is Droupadi Murmu. We will discuss this later. First let's understand it from the beginning i.e. the Election of the President.

<h2 id="content-id-35366-1">Election of the President</h2>

The President is elected not directly by the people but by the members of an electoral college. The electoral college consists of:

<ol>
	<li>Elected members of both houses of the Parliament</li>
	<li>Elected members of the state legislative assemblies</li>
	<li>Elected members of the legislative assemblies of the Union Territories of Delhi and Puducherry</li>
</ol>

Note that only Elected members vote for the Presidential election and nominated members do not participate. 

However the number of elected members are different in each state legislative assembly. The number of elected members in the states as a whole is much more than the number of elected members of both houses of the parliament. If each of these elected members were to have one vote each, the election results would be lopsided. 
The constitution provides a way to bring uniformity in the scale of representation of each state as well as parity between states as a whole and the Union. To achieve this, there are two different formulas to decide the weightage of the votes of MPs and MLAs.

1) Value of the vote of an MLA = [(Total population of State)/(Total number of elected members of state legislative assembly)] × 1/100

2) Value of the vote of an MP = [(Total value of votes of all MLAs all states)/(Total number of elected MPs)] × 1/100

<h3>Method of Election:</h3>

The method followed is proportional representation by means of single transferable vote. To be declared as President, a candidate must secure a fixed quota of votes known as electoral quota.

Electoral Quota = [(Total number of valid votes polled)/2] + 1

Step 1: The voters cast their vote by marking their order of preference (1, 2, 3, 4, etc.) against the names of all candidates.

Step 2: All the 1st preference votes are counted. The candidate who secures the electoral quota wins. If no one secures the quota then we move to step 3.

Step 3: The candidate with least number of first preference votes is eliminated. His second preference votes will now be transferred to the first preference votes of other candidates.

Step 2 and 3 are repeated till any one candidate secures the electoral quota and is elected as the President of India.

Any disputes regarding the President’s elections are handled by the Supreme Court.

<h3>Qualifications:</h3>

A candidate has to meet some qualifications to be elected as the president. Those qualifications of the President are:

<ol>
	<li>He should be an Indian Citizen</li>
	<li>His age should be a minimum of 35 years</li>
	<li>He should qualify the conditions to be elected as a member of the Lok Sabha</li>
	<li>He should not hold any office of profit under the central government, state government, or any public authority</li>
</ol>

<h3>Oath:</h3>

The president is required to make and subscribe in the presence of the Chief Justice of India — or in his absence, the senior-most judge of the supreme court — an oath or affirmation that he/she shall protect, preserve and defend the constitution as follows:

I, (name), do swear in the name of God (or solemnly affirm) that I will faithfully execute the office of President (or discharge the functions of the President) of the Republic of India, and will to the best of my ability preserve, protect and defend the Constitution and the law, and that I will devote myself to the service and well-being of the people of the Republic of India.

— Article 60, Constitution of India

<h3>Conditions:</h3>

The following conditions have been laid down for the President’s office:

<ul>
	<li>He should not be a member of either House of Parliament or a House of the state legislature. If any such member is elected as President, he is considered to have vacated that seat on joining the office of the President.</li>
	<li>He should not hold any office of profit.</li>
	<li>He is entitled to stay at the Rashtrapati Bhavan, without paying rent.</li>
	<li>He gets emoluments and allowances and privileges as determined by the Parliament.</li>
	<li>These allowances and emoluments cannot be reduced during his tenure.</li>
</ul>

Now, let's look at the most important topic which is asked in almost every exam.

<h2 id="content-id-35366-2">Impeachment of the Indian President (Article 61)</h2>

Article 61: Procedure for Impeachment of the President.

The only condition for the initiation of impeachment of the Indian president is the ‘violation of the constitution.’ Although, the Indian Constitution does not contain any definition of ‘violation of the constitution.’

This feature of the Indian Constitution is borrowed from the constitution of the United States of America (USA). 

<h3>The Procedure:</h3>

(1) When a President is to be impeached for violation of the Constitution, the charge shall be preferred by either House of Parliament.

(2) No such charge shall be preferred unless –

<ol>
	<li>the proposal to prefer such charge is contained in a resolution which has been moved after at least fourteen days’ notice in writing signed by not less than one-fourth of the total number of members of the House has been given of their intention to move the resolution, and</li>
	<li>such a resolution has been passed by a majority of not less than two-thirds of the total membership of the House.</li>
</ol>

(3) When a charge has been so preferred by either House of Parliament, the other House shall investigate the charge or cause the charge to be investigated and the President shall have the right to appear and to be represented at such investigation.

(4) If as a result of the investigation a resolution is passed by a majority of not less than two-thirds of the total membership of the House by which the charge was investigated or caused to be investigated, declaring that the charge preferred against the President has been sustained, such resolution shall have the effect of removing the President from his office as from the date on which the resolution is so passed.

<ol>
	<li>Any of the two houses initiate the impeachment charge</li>
	<li>The house passes the charges with 2/3rd majority and sends it to another house</li>
	<li>The other house investigates the charges</li>
	<li>The other house also agrees and passes the charges with 2/3rd majority</li>
	<li>The president stands removed</li>
</ol>

After the President is removed from the office the Vice-President discharges the duties as President;

As per the President’s Act 1969; if the Vice-President office is vacant too, Chief Justice of India (CJI) (or in his absence); Supreme Court’s senior-most judge, discharges the functions of the President (till new President is elected.)

<h2 id="content-id-35366-3">Vacancy in the office for the President</h2>

Let's first understand the conditions for the vacancy in the office of the President. The office of the President falls vacant under the following conditions:

<ol>
	<li>Expiry of his tenure of five years.</li>
	<li>By reason of his resignation.</li>
	<li>His removal by the process of impeachment.</li>
	<li>By reason of his death.</li>
	<li>Other reasons. e.g., when he becomes disqualified to hold office or when his election is declared void.</li>
</ol>

Article 65 of the Indian constitution says that the Vice-President of India will have to discharge the duties, if the office falls vacant due to any reason other than the expiry of the term. The Vice-President reverts to their office when a new president is elected and enters office. When the president is unable to act because of absence, illness or any other cause, the vice-president discharges the president's functions until the president resumes the duties.

Process for filling the vacancy in President’s Office:

1. In case of expiry of his tenure of five years

<ul>
	<li>An election to fill the vacancy must be held before the expiration of the term i.e 5 years.</li>
	<li>In case of any delay in conducting the election for the new President by any reason, the outgoing President continues to hold office (beyond his term of five years) until his successor assumes charge.</li>
	<li>This is provided in the Constitution to prevent an interregnum i.e., void or gap or break.</li>
	<li>In this scenario, the Vice-President does not act as President.</li>
</ul>

 2. In case of his resignation, removal, death or other reason

<ul>
	<li>If the office falls vacant due to resignation, removal, death or otherwise, then the election to fill the vacancy should be held within 6 months from the date of the occurrence of such vacancy.</li>
	<li>The newly elected President will remain in office for a full term of 5 years from the date he assumes charge.</li>
	<li>In this scenario, the Vice-President acts as the President until a new President is elected.</li>
	<li>Also, if the sitting President is unable to discharge his functions due to absence, illness etc. the Vice-President discharges his functions until the President resumes his office.</li>
	<li>In case the office of Vice-President is vacant, the Chief Justice of India acts as President.</li>
	<li>If his office too is vacant, the senior most judge of the Supreme Court (who is available) acts as the President or discharges the functions of the President.</li>
	<li>When any other person like the VP, CJI, or the senior-most judge of the Supreme Court acts as the President, they enjoy all the powers and immunities of the President and are entitled to such emoluments, allowances and privileges as are determined by the Parliament.</li>
</ul>

The Indian President is the head of the state. He is the first citizen of India and is a symbol of solidarity, unity, and integrity of the nation. He is a part of the Union Executive along with the Vice-President, Prime Minister, Council of Ministers, and Attorney-General of India. <h2 id="content-id-48370-0">Annual Financial Statement (Budget)</h2>

The term ‘Budget’ has nowhere been mentioned in the Constitution. It is the admired name for the ‘Annual Financial Statement’ that has been dealt with in Article 112 of the Constitution. The budget is a statement of the approximate receipts and expenditure of the Government of India in a financial year. Expenditure on revenue accounts should be segregated from other expenditure. Also expenditure charged on the consolidated fund should be distinguished from the expense made from the fund.

<h3>Following are the Expenses charged upon the Consolidated Fund:</h3>

<ol>
	<li>Salaries, pensions or expenses of the President, CAG, UPSC, Supreme Court judge. </li>
	<li>Pensions of High Court judges, Presiding or deputy presiding officers of Rajya Sabha and Lok Sabha. </li>
	<li>Loans of the Government of India, Amounts to satisfy any judgment, expense declared by parliament to be charged on the fund. These expenditures are discussed but not put to vote in the house.</li>

<h3>Stages of Enactment of Budget:</h3>

The Budget goes through the following 6 stages in the Parliament:

1. Presentation of budget: The Finance minister presents the General Budget in the Lok Sabha. It is started by an introduction speech and concluded with the taxation proposals or any alterations in the existing tax regime.

2. General Budget: It takes place in both the houses of the parliament encompassing the discussion of the general principles or the budget in its entirety. Neither a Cut Motion can be moved nor can the Budget be submitted to the vote of the house. It becomes the responsibility of the Finance Minister to give a reply at the closure of the discussion.

3. Scrutiny by Departmental committees: An in-depth scrutiny of demand for grants by department is done by each departmental standing committee of parliament. Three to four weeks are set for this purpose and the house remains in recess during this period. The standing committees prepare a report to the house at the end.

4. Voting on Demand of Grants: The MPs of Lok Sabha study and vote on each demand for grant. The Lok Sabha only would vote on demand for grants and no voting is allowed on the expenditure charged on the consolidated fund of India. Members of Parliament (MPs) could move motion for reduction of a grant called Cut Motions;

5. Passing of Appropriation Bill: Appropriation bill gives power to the government to withdraw funds from the Consolidated Fund of India for meeting the expenditure during the Financial year. Money cannot be withdrawn by the government from the Consolidated Fund of India except appropriation made by law.

<ul>
	<li>No amendments could be made on these in any house</li>
	<li>After the bill receives approval of the President it becomes an appropriation act. </li>
	<li>Finance bill is also presented including provisions for taxation. It is like a money bill but amendments could be made seeking to reduce or remove a tax. This allows taxes to be levied. Consolidated Fund of India for meeting the expenditure during the Financial year. Money cannot be withdrawn by the government from the Consolidated Fund of India except appropriation made by law.</li>

<h2 id="content-id-48370-1">Question Hour</h2>

The first hour of every Parliamentary sitting is called the question hour. Members can ask three types of questions and answers by Ministers.

<h3>About Question Hour:</h3>

<ul>
	<li>Definition: The first hour of every parliamentary sitting is designated for the Question Hour. But, in 2014 the Question Hour in the Rajya Sabha was shifted from 11 am to 12 noon.</li>
	<li>During this, Members of Parliament (MPs) ask questions to ministers and hold them accountable for the functioning of their ministries. </li>
	<li>The members can also ask the questions to the private members (MPs who are not ministers including members of the Ruling Party). </li>
	<li>Regulation: It is regulated according to parliamentary rules. The presiding officers of both Houses (Rajya Sabha and Lok Sabha) are the final authority with respect to the conduct of Question Hour.</li>

<h2 id="content-id-48370-2">Zero Hour</h2>

The time directly following the Question Hour has come to be known as Zero Hour. It starts at around 12 noon (hence the name) and members could, with prior notice to the Speaker, raise issues of importance during this time.

<h3>About Zero Hour:</h3>

<ul>
	<li>While Question Hour is strictly governed, Zero Hour is an Indian innovation in parliamentary system. It is not mentioned in the rules of procedure.</li>
	<li>The concept of Zero Hour started in the first decade of the Indian Parliament when Members of Parliament (MPs) felt the need for raising important constituency and national issues.</li>
	<li>This is why it is popularly called Zero Hour and the issues raised during this time as Zero Hour submissions.</li>
	<li>Its importance can be analysed from the support it receives from citizens, media, Members of Parliament (MPs) and presiding officers despite not being part of the rulebook.</li>

Short Duration Discussion: It's also known as a two-hour discussion because the maximum time allotted for such a discussion is two hours. Members of Parliament can initiate debates on matters of pressing public concern.

<h2 id="content-id-48370-3">Types of Questions in the Parliament</h2>

Starred Questions: These are Questions to which answers are supposedly given orally on the floor of the House during the Question Hour. It requires an oral answer and hence supplementary questions can follow. These are eminent in the printed lists by asterisks. Around 15 such questions are recorded each day.

Unstarred Questions: Such Questions are answered with written answers by Ministers which are deemed to have been laid on the Table of the House at the end of the Question Hour.

Short Notice Questions: Such questions can be asked orally after the Question Hour at a notice shorter than that prescribed for Starred and Unstarred Questions. These should relate to a subject-matter considered by the Chairman to be of urgent public importance.
